Detroit Councilman Sentenced on Misdemeanor

Scott Benson, a Detroit City Councilman, was sentenced recently to spend seven days in jail after he plead guilty to a misdemeanor drunk driving charge.  But unlike the courtroom fiasco involving Flint Councilman Eric Mays, this affair was a rather somber and formal proceeding.

According to police records, Benson was arrested by officers from the Southfield Police Department on June 29th 2014, after a 911 operator received a call from a concerned motorist. Apparently Benson was sitting, slumped over behind the wheel of a black 2008 Ford Crown Victoria, at a traffic light on 8 Mile Rd shortly before 7:30 in the evening. Read more ›

There are very mixed opinions out there about judicial leniency when it comes to sentencing. Bay County Intoxicated Driver Drives Self to Jail

It seems about as unlikely as lightning hitting the same tree twice, or a card player pulling a King from the same deck four times in a row, but unlikely doesn’t mean impossible. And an intoxicated driver saving the police time by driving herself to jail? Believe it or not, it just happened again.

A 49-year-old woman, whose name has not yet been released pending her arraignment, apparently drove herself, not home, and not to another bar, but directly to the local jail. Why? No one is sure yet, but the story is interesting none-the-less. Read more ›

Will Drunk Driving Dad Face Murder Charge?

Jose R. Teneyuque, the 40-year-old Saginaw father who is accused of driving drunk and killing his own daughter in a terrible accident, will stay in jail until his trial later this month. But it will be a few days yet before the judge decides whether or not that trial will include a murder charge.

Last week, Saginaw County Circuit Judge Janet M. Boes heard arguments from both Patrick Duggan, the Assistant Prosecutor, and from Teneyuque’s attorney Alan Crawford. The arguments pertained to Crawford’s motion to quash the murder charge against his client, which was only one of several motions filed by the defense. Read more ›

Controversial DUI Attorney’s Advice

A Good Idea for Drivers?…. or Not?

Warren Redlich, an attorney practicing in southern Florida and the founder of Fair DUI, recently introduced a rather revolutionary approach to interacting with police officers when you are pulled over. Available for free (you just download it and print it out) on the Fair DUI blog is a flyer that a driver can press up against their window for a police officer to read in the event of a traffic stop.

What does the flyer say exactly? Well, it’s slightly different for each state, because each state has slightly different laws regarding what a civilian’s rights are when interacting with police, but the Florida version, which started this internet sensation, contains the following words: Read more ›

Drugged Driving vs. Drunk Driving

Michigan’s New Law

When Daniel Boyd Jr. crashed his car into the back of a stationary semitrailer, he was highly intoxicated. However, he was not drunk. In fact, his blood alcohol content was .00. How can this be, you may wonder? Sadly, it is really no mystery, although a new Michigan law that went into effect at the new year may help to prevent these types of accidents in the future.

Boyd was under the influence of prescription hydrocodone at the time of the accident. This drug can significantly affect a driver’s ability to perform behind the wheel but has none of the same telltale signs that police have come to rely on for detecting drunk drivers. Signs such as a pungent odor when first coming into contact with the driver, and the obvious breathalyzer test results. Read more ›
